In consideration of being permitted to enter, use, and participate in activities at Yoyo Golf Studio (“Studio,” “we,” “us,” or “our”), I, the undersigned participant (“Participant,” “I,” or “my”), agree to the following:

鉴于本人获准进入并使用 Yoyo Golf Studio(以下简称“球馆”、“我们”) ,以及参与球馆内的各项活动,本人(以下简称“参与者”、“本人”)特此确认并同意如下条款:

I understand and acknowledge that participation in golf-related activities (including but not limited to golf swings, ball striking, simulator play, lessons, practice, training, use of golf equipment, and presence within the Studio) involves inherent risks, including but not limited to:

• Being struck by golf balls, clubs, or equipment • Slips, falls, collisions, or physical strain • Equipment malfunction or misuse • Injuries ranging from minor strains to serious bodily injury or death

I voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, even if arising from the negligence of the Studio or others.

本人理解并确认,参与高尔夫相关活动(包括但不限于挥杆、击球、模拟器练习、课程教学、训练、使用高尔夫设备以及在球馆场地内活动)具有固有风险,该等风险包括但不限于:

• 被高尔夫球、球杆或其他设备击中 • 滑倒、跌倒、碰撞或身体拉伤 • 设备故障或不当使用 • 从轻微受伤到严重人身伤害,甚至死亡

本人自愿承担所有上述风险,无论该等风险是已知或未知、可预见或不可预见,即使该等风险因球馆或他人的疏忽而产生。

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Yoyo Golf Studio, its owners, officers, employees, instructors, contractors, agents, affiliates, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, or liabilities, whether arising from negligence or otherwise, related to or arising out of my participation in any Studio activities or use of Studio facilities.

在法律允许的最大范围内,本人特此 放弃、解除并免除 对 Yoyo Golf Studio 及其所有者、管理人员、员工、教练、承包商、代理人、关联方及代表(统称“被免责方”)因本人参与球馆活动或使用球馆设施而产生的 任何及所有索赔、要求、诉讼、损害、损失或责任,无论该等责任是否因疏忽或其他原因产生。

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• My actions or omissions while at the Studio

• My violation of Studio rules or policies

• Any injury or damage I cause to myself, other persons, or property

本人同意对被免责方予以 赔偿、辩护并使其免受损害,包括但不限于合理的律师费及相关费用,如因以下原因引起任何索赔或损失:

• 本人在球馆内的行为或疏忽

• 本人违反球馆规章制度或安全规定

• 本人对自身、他人或财产造成的任何伤害或损失

I represent that I am physically and mentally capable of participating in golf activities and have no medical condition that would prevent safe participation. I acknowledge that the Studio does not provide medical advice or supervision.

本人确认自己在身体及精神上均适合参与高尔夫活动,且不存在任何可能影响安全参与的健康问题。本人理解球馆不提供医疗建议或医疗监督。

I understand that the Studio is not responsible for lost, stolen, or damaged personal property, including golf clubs, equipment, or valuables brought onto the premises.

本人理解并同意,球馆 不对任何个人财物的遗失、被盗或损坏承担责任,包括但不限于高尔夫球杆、设备或贵重物品。

I agree to comply with all Studio rules, safety instructions, signage, and staff directions. Failure to do so may result in removal from the premises without refund.

本人同意遵守球馆的 所有规章制度、安全指示、告示及工作人员的指引。如违反相关规定,球馆有权要求本人离场,且不予退款。

If the Participant is under the age of 18, this waiver must be signed by a parent or legal guardian, who agrees to all terms on behalf of the minor and assumes full responsibility for the minor’s participation.

如参与者未满 18 周岁,须由其 父母或法定监护人 签署本声明。签署人同意代表未成年人接受本声明全部条款,并对其参与活动承担全部责任。

This Agreement shall be governed by and construed in accordance with the laws of the State of California. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

本声明受 加利福尼亚州法律管辖并依其解释。如本声明任何条款被认定为无效或不可执行,其余条款仍继续有效。

I acknowledge that I have read this Liability Waiver in its entirety, fully understand its terms, and sign it freely and voluntarily, intending to be legally bound.

本人确认已 完整阅读并充分理解 本《责任豁免与风险承担声明》的全部内容,并在自愿、无任何胁迫的情况下签署,意在受其法律约束。

I acknowledge that upon checking in or using the Studio facilities, I have read, understood, and agree to be bound by all terms of this Liability Waiver, Assumption of Risk, and Release of Claims, and I voluntarily accept its legal effect. If I am under the age of 18, I acknowledge that my parent or legal guardian has read and agreed to this waiver and has authorized my participation in all activities at Yoyo Golf Studio.

本人确认:一旦完成签到(Check-In)或使用球馆设施,即表示本人已阅读、理解并同意遵守本《责任豁免、风险承担及索赔放弃声明》的全部条款,并自愿接受其法律约束。如本人为未满 18 周岁的未成年人,则本人确认其父母或法定监护人已阅读并同意本声明,并授权本人参与 Yoyo Golf Studio 的所有相关活动。
