By making a booking, entering the venue, participating in any activity, or using any simulator, golf club, equipment or other facility provided by Golfjoy, you confirm that you have read, understood and agreed to these terms.

These terms apply to the person making the booking, every participant included in the booking, guests, spectators and accompanying persons, and parents or legal guardians acting on behalf of minors. The person making the booking is responsible for ensuring that all members of the group understand and comply with these terms and all reasonable instructions given by Golfjoy staff.

本条款适用于预约人、预约中包含的所有参与者、陪同人员、访客及观众，以及代表未成年人确认本条款的父母或法定监护人。预约人有责任确保同行人员了解并遵守本条款，以及 Golfjoy 工作人员提出的所有合理要求和安全指示。

Bookings are subject to availability and confirmation. Standard bookings may be made in 30-minute increments, including sessions of 30, 60, 90 or 120 minutes. Unless otherwise approved by Golfjoy, each customer may hold no more than two future bookings at the same time. Customers may check in up to 15 minutes before the scheduled start time.

所有预约均以实际可用时间及系统确认为准。普通预约以 30 分钟为一个时间单位，可预约 30 分钟、60 分钟、90 分钟或 120 分钟。除非获得 Golfjoy 另行批准，每位客户同时最多可持有两个未来预约。客户可在预约开始前 15 分钟办理签到。

A booking begins and ends at the scheduled time. Late arrival does not automatically extend the booking period or entitle the customer to a refund or credit. Extensions of 30 or 60 minutes may be available at the venue, subject to availability and payment of the applicable fee. All prices include GST unless expressly stated otherwise. Payments are made at the venue unless another payment method is specifically offered.

预约使用时间以系统显示的开始时间和结束时间为准。迟到不会自动延长预约时间，也不代表客户有权获得退款或补偿。如后续时段可用，客户可在场馆现场申请延长 30 分钟或 60 分钟，并支付相应费用。除非另有明确说明，所有价格均已包含 GST。除非场馆另行提供其他付款方式，客户应在场馆现场完成付款。

The cancellation and refund conditions displayed at the time of booking form part of these terms. A customer who does not check in or attend within a reasonable period after the scheduled start time may have the booking cancelled.

客户在预约时看到的取消及退款政策，构成本条款的一部分。如客户未在预约时间内签到，或未在合理时间内到达，Golfjoy 有权取消该预约。

Golfjoy may cancel or reschedule a booking where reasonably necessary because of equipment failure, maintenance requirements, safety concerns, power, internet or system outages, emergencies, or circumstances outside Golfjoy’s reasonable control.

如因设备故障、设备维护、安全问题、停电、断网、系统故障、突发事件，或其他超出 Golfjoy 合理控制范围的情况确有必要，Golfjoy 可取消或调整预约。

Where Golfjoy cancels a booking and cannot provide a reasonable replacement session, the customer will be offered an appropriate rescheduled booking, account credit or refund, subject to the customer’s rights under New Zealand law.

如 Golfjoy 取消预约且无法提供合理的替代时段，将根据实际情况向客户提供改期、账户余额或退款，同时保留客户根据新西兰法律享有的权利。

Weekly passes are valid for seven days, and monthly passes are valid for 30 days, from the applicable activation date. Unused balances on hourly cards do not expire unless otherwise clearly stated at the time of purchase.

周卡有效期为 7 天，月卡有效期为 30 天，具体起算时间以激活日期为准。小时卡内未使用的余额永久有效，除非购买时另有明确说明。

Weekly passes, monthly passes and hourly cards may not be used to book private rooms unless Golfjoy expressly approves otherwise. Memberships, passes, credits and prepaid cards are personal to the registered customer and may not be transferred, resold or shared without Golfjoy’s permission.

周卡、月卡及小时卡不得用于预约包房，除非 Golfjoy 明确同意。会员、套餐、余额及储值卡原则上仅限登记客户本人使用，未经 Golfjoy 同意，不得转让、转售或与他人共享。

Customers must comply with all safety signs, venue rules and reasonable instructions given by Golfjoy staff. While using a simulator bay: 1. Only one person may enter the designated hitting area or swing a golf club at a time. 2. All other persons must remain behind the player and outside the swing area. 3. Customers must check that the surrounding area is clear before swinging. 4. Practice swings must only be made inside the designated hitting area. 5. Golf balls must only be hit towards the simulator screen. 6. Customers must not intentionally hit balls towards walls, ceilings, equipment, staff or other persons. 7. Customers must not move, adjust, climb on or interfere with sensors, projectors, computers, screens, platforms, electrical equipment or other fixed equipment. 8. Suitable footwear must be worn. Running, pushing, fighting or reckless behaviour is prohibited. 9. Food and drinks must be kept away from computers, sensors, hitting areas and electrical equipment. 10. Any damaged, loose or unsafe equipment must be reported immediately and must not be used. 11. Customers must stop using the equipment immediately when instructed by staff. 12. Emergency exits and access routes must remain clear at all times.

客户必须遵守场馆内的安全标识、场馆规则及工作人员提出的合理指示。使用模拟器打位时：1. 每次仅允许一人进入指定击球区域或挥杆。2. 其他人员必须站在击球者身后，并离开挥杆范围。3. 挥杆前必须确认周围没有其他人员或障碍物。4. 试挥只能在指定击球区域内进行。5. 高尔夫球只能击向模拟器幕布方向。6. 严禁故意将球击向墙壁、天花板、设备、工作人员或其他人员。7. 未经允许，不得移动、调整、攀爬或干扰传感器、投影仪、电脑、幕布、平台、电气设备或其他固定设施。8. 客户应穿着适当的鞋子，场馆内禁止奔跑、推搡、打闹或实施危险行为。9. 食物和饮料应远离电脑、传感器、击球区域及电气设备。10. 如发现设备损坏、松动或存在安全隐患，应立即停止使用并通知工作人员。11. 工作人员要求停止使用设备时，客户必须立即停止。12. 紧急出口及疏散通道必须始终保持畅通。

Golfjoy may require any person who behaves dangerously, disruptively, abusively or unlawfully to leave the venue. A refund may be refused where reasonable in the circumstances.

如客户存在危险、扰乱秩序、辱骂他人或违法行为，Golfjoy 有权要求其离场。在合理情况下，相关费用可不予退还。

Customers must not use the facilities while materially impaired by alcohol, recreational drugs, medication, fatigue or any other condition that makes participation unsafe.

客户不得在受到酒精、娱乐性药物、处方药物、疲劳或其他因素明显影响，且可能危及安全的情况下使用场馆设施。

Golfjoy may refuse entry or stop a person from participating where staff reasonably believe that the person poses a safety risk to themselves or others.

如工作人员有合理理由认为某位客户可能对本人或他人造成安全风险，Golfjoy 有权拒绝其进入场馆或要求其停止参与活动。

Golf simulator activities involve physical movement, including swinging golf clubs, bending, twisting and repeated movements.

室内高尔夫模拟活动涉及挥杆、弯腰、转体及重复动作，具有一定体力要求。

Customers are responsible for deciding whether they are physically capable of participating. Customers should not participate where they have an injury, medical condition or other limitation that may make the activity unsafe, unless they have obtained appropriate medical advice.

客户应自行判断身体状况是否适合参与。如客户存在受伤、疾病、身体不适或其他可能影响安全的情况，应在参与前取得适当的医疗建议。

Customers must stop participating and inform staff immediately if they experience pain, dizziness, breathing difficulty, loss of balance or any other concerning symptom.

如活动过程中出现疼痛、头晕、呼吸困难、失去平衡或其他异常症状，客户应立即停止活动并通知工作人员。

Customers acknowledge that indoor golf and simulator activities involve inherent risks, including being struck by a golf club or golf ball, collisions with other participants or equipment, slips, trips and falls, muscular strain, joint injury or aggravation of an existing condition, equipment or software malfunction, unexpected ball movement or rebound, and injury caused by another participant failing to follow instructions.

客户理解并确认，室内高尔夫及模拟器活动存在一定固有风险，包括但不限于被高尔夫球杆或高尔夫球击中，与其他参与者或设备发生碰撞，滑倒、绊倒或跌倒，肌肉拉伤、关节受伤或原有伤病加重，设备、软件或系统故障，高尔夫球异常移动或反弹，以及其他参与者未遵守安全规则而造成的伤害。

Customers voluntarily accept the ordinary and inherent risks of participating, except to the extent that loss or injury is caused by Golfjoy’s failure to exercise reasonable care and skill or by another liability that cannot lawfully be excluded.

客户自愿承担参与此类活动过程中通常存在及无法完全消除的合理风险。但如损失或伤害是由于 Golfjoy 未尽合理注意义务、未提供合理技能和服务，或属于依法不得排除的责任，Golfjoy 仍依法承担相应责任。

A person under 16 years of age must be accompanied and actively supervised by a responsible adult unless Golfjoy has approved another arrangement.

16 岁以下未成年人必须由负责任的成年人陪同并进行有效监督，除非 Golfjoy 事先批准其他安排。

The parent or legal guardian of a minor must consent to the minor’s participation and accept these terms on the minor’s behalf. The supervising adult is responsible for ensuring that the minor follows all safety instructions and venue rules.

未成年人的父母或法定监护人必须同意其参与活动，并代表其接受本条款。陪同成年人有责任确保未成年人遵守所有安全指示及场馆规则。

Golfjoy may require proof of age or parental or guardian consent.

Golfjoy 有权要求客户提供年龄证明或父母、监护人同意证明。

Customers are responsible for their own clothing, golf clubs, electronic devices, bags and other personal property.

客户应自行保管衣物、高尔夫球杆、电子设备、包袋及其他个人物品。

Golfjoy is not responsible for loss, theft or damage to unattended personal property unless the loss or damage was caused by Golfjoy’s failure to exercise reasonable care.

除非个人物品的丢失、被盗或损坏是由于 Golfjoy 未尽合理注意义务造成，否则 Golfjoy 不承担相关责任。

Any property left at the venue may be retained for a reasonable period and then disposed of or donated if it is not collected.

客户遗留在场馆的物品，Golfjoy 可代为保管一段合理时间。逾期无人领取的，Golfjoy 有权对物品进行处理或捐赠。

Customers must use all facilities and equipment carefully and only for their intended purpose.

A customer may be required to pay the reasonable cost of repairing or replacing property damaged as a direct result of that customer’s intentional conduct, reckless behaviour, negligent misuse, breach of these terms, or failure to follow staff instructions. The person making a group booking must reasonably assist Golfjoy in identifying the person responsible for any damage.

如客户因故意行为、鲁莽或危险行为、疏忽或不当使用设备、违反本条款，或拒不遵守工作人员指示而直接造成场馆或设备损坏，Golfjoy 有权要求客户承担合理的维修或更换费用。如损坏由预约同行人员造成，预约人应合理配合 Golfjoy 确认实际责任人。

Normal wear and tear, equipment defects and damage not caused by the customer will not be charged to the customer.

正常损耗、设备自身缺陷，或并非由客户造成的损坏，不应由客户承担费用。

Golf simulators rely on computers, sensors, projectors, software, internet connections and other technical systems. Golfjoy does not guarantee that every course, game mode, online function, software feature or third-party service will be available at all times.

高尔夫模拟器依赖电脑、传感器、投影设备、软件、网络及其他技术系统运行。Golfjoy 不保证所有球场、游戏模式、联网功能、软件功能或第三方服务始终可用。

Where a significant technical failure materially prevents use of the booked service, Golfjoy will take reasonable steps to repair the issue, move the customer to another available bay, extend or reschedule the session, or provide an appropriate account credit or refund.

如重大技术故障导致客户无法正常使用所预约的主要服务，Golfjoy 将根据实际情况采取合理措施，包括尝试修复设备、更换至其他可用打位、延长使用时间或安排改期，以及提供合理的账户余额或退款。

To the maximum extent permitted by New Zealand law, Golfjoy is not liable for loss or damage resulting from the ordinary and inherent risks of indoor golf, a customer’s breach of these terms, failure to follow safety instructions, misuse of equipment, the conduct of another customer or third party, personal property left unattended, or events outside Golfjoy’s reasonable control.

在新西兰法律允许的最大范围内，对于室内高尔夫活动通常存在或固有的风险、客户违反本条款、客户未遵守安全要求、客户不当使用设备、其他客户或第三方的行为、无人看管的个人物品遗失或损坏，或超出 Golfjoy 合理控制范围的事件造成的损失或伤害，Golfjoy 不承担责任。

Golfjoy does not exclude or limit liability for failure to exercise reasonable care and skill, fraud or wilful misconduct, liability that cannot lawfully be excluded, its obligations under the Health and Safety at Work Act 2015, or rights and remedies available under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other applicable New Zealand law.

Golfjoy 不排除或限制未尽合理注意义务或未提供合理技能和服务、欺诈或故意不当行为、根据法律不得排除或限制的责任、《2015 年工作健康与安全法》项下的义务，或《1993 年消费者保障法》《1986 年公平交易法》及其他适用的新西兰法律赋予客户的权利和救济。

Nothing in these terms requires a customer to waive a legal right that cannot lawfully be waived.

本条款中的任何内容均不应被理解为要求客户放弃依法不得放弃的权利。

A customer is responsible for loss, damage, costs or claims suffered by Golfjoy to the extent directly caused by that customer’s intentional misconduct, negligence, unlawful conduct or material breach of these terms.

如因客户的故意不当行为、疏忽、违法行为或严重违反本条款，直接导致 Golfjoy 遭受损失、损坏、费用或第三方索赔，客户应在依法合理的范围内承担相应责任。

This clause does not require a customer to compensate Golfjoy for loss caused by Golfjoy’s own negligence, breach of statutory duty or other conduct for which Golfjoy is legally responsible.

本条款不要求客户对 Golfjoy 自身的疏忽、违反法定义务或其他应由 Golfjoy 依法承担责任的行为作出赔偿。

Customers must not photograph or record other customers or staff without their consent.

未经他人同意，客户不得拍摄或录制其他客户或工作人员。

Golfjoy may operate CCTV in clearly identified areas for safety, security, incident investigation and protection of property. CCTV will not be used in toilets or other areas where individuals would reasonably expect privacy.

Golfjoy 可在有明确标识的区域使用闭路电视监控，用于场馆安全、财产保护及事故调查。卫生间及其他客户合理期待隐私的区域不会设置监控设备。

Photographs or recordings that identify a customer will not be used for advertising or promotional purposes without appropriate consent.

未经客户适当同意，Golfjoy 不会将能够识别客户身份的照片或录像用于广告或宣传用途。

Golfjoy may collect personal information reasonably necessary to process and manage bookings, communicate with customers, administer memberships and prepaid balances, respond to incidents and customer enquiries, protect the safety and security of the venue, and meet legal and operational requirements.

Golfjoy 可在合理必要范围内收集客户个人信息，用于处理和管理预约、与客户沟通、管理会员、套餐和账户余额、处理事故及客户咨询、保障场馆安全，以及满足法律及日常运营要求。

Personal information will be handled in accordance with the Privacy Act 2020.

Customers may request access to, or correction of, their personal information by contacting Golfjoy.

客户可联系 Golfjoy，申请查询或更正其个人信息。

Golfjoy may reasonably refuse entry, suspend a booking or terminate a session where a customer creates a health or safety risk, damages or misuses equipment, threatens, abuses or harasses staff or other customers, engages in illegal conduct, repeatedly breaches venue rules, or provides materially false booking information.

如客户对本人或他人造成健康或安全风险、故意损坏或不当使用设备、威胁、辱骂或骚扰工作人员或其他客户、从事违法行为、多次违反场馆规则，或提供严重不实的预约信息，Golfjoy 有权合理拒绝其进入场馆、暂停预约或终止使用。

Whether a refund is provided will depend on the circumstances and the customer’s rights under New Zealand law.

是否退款将根据实际情况、本条款及客户依法享有的权利确定。

Golfjoy may update these terms from time to time. Any material change will apply to future bookings after the updated terms have been made available to customers.

Golfjoy 可根据实际运营情况不时更新本条款。任何重大修改将在更新后的条款向客户公布后，适用于未来预约。

The terms applying at the time a confirmed booking was made will generally continue to apply to that booking, unless a change is required by law or necessary to address an immediate safety issue.

已确认预约原则上继续适用预约确认时的条款，除非法律要求修改，或因处理紧急安全问题必须立即变更。

These terms are governed by the laws of New Zealand. Any dispute will be dealt with by the courts or tribunals of New Zealand with jurisdiction over the matter.

本条款适用新西兰法律。因本条款产生的任何争议，应由具有相应管辖权的新西兰法院或争议解决机构处理。

By selecting I Agree, signing this document, making a booking or participating in an activity at Golfjoy, I confirm that I have read and understood these terms, I agree to comply with all venue and safety rules, I understand the inherent risks associated with using golf clubs and simulator facilities, I am physically capable of participating or have obtained appropriate medical advice, I accept responsibility for any minors under my supervision, and I understand that these terms do not remove any rights or protections that cannot lawfully be excluded under New Zealand law.

当客户点击我同意、签署本文件、完成预约或参与 Golfjoy 场馆活动时，即表示客户确认已阅读并理解本条款，同意遵守场馆规则及安全要求，已了解使用高尔夫球杆及模拟器设施存在一定固有风险，确认自身身体状况适合参与活动或已取得适当医疗建议，同意对本人监护的未成年人承担监督责任，并理解本条款不会排除根据新西兰法律依法不得排除的权利或保护。
